The FDA initiated forceful actions focused on Retailers and manufacturers to combat youth access to e-cigarettes as part of its Youth Tobacco Prevention Plan. In 2019 CITGO was listed as a national chain with “disturbingly high rates of violations for illegal sales of tobacco products to minors.” Violations were found at 35-44 percent of all inspected stores. While the FDA continues to issue warning letters and fines, the good news is that — thanks to your vigilance — there are far fewer violations so far in 2021!
In December 2019, the FDA officially raised the federal minimum age to purchase any tobacco products from 18 to 21. The new minimum age applies to all tobacco products, including e-cigarettes, cigars and vaping cartridges.
Twenty-five (25) points will be deducted from the quarterly Trimark of Excellence mystery shop scores for any retail locations receiving a tobacco age sale citation as reported on the FDA website. Points will be deducted the following quarter resulting in an immediate shop failure.
